North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by due to lack of inspections and posting of operators manuals for the equipment being used: a)all bays- All automotive lifts in the bays were being operated without the benefit of the operating instructions posted in a conspicuous location in the lift area. (ref para 7.2.1 ANSI B153.1-1990) b)all bays- all automotive lifts in the bays were being operated without an employer/owner establishing a periodic inspection procedure as recommended by the manufacture of the lift. (ref para 7.3, ANSI B153.1-1990)
