Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Old DOE Administration Building, Demolition site: On October 29, 2008, operator of a Hitachi excavator was operating the equipment to move block cement and to knock down the old structure during demolition of the old building. Regular pieces of rebar were modified, bent and used as pins to hold the bucket or the shovel of the excavator instead of pins originally provided by the manufacturer. Slippage of the home-made pins could easily caused an unintended separation of the bucket during operation or maintenance, potentially striking or injuring employees.
