Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to severe burn injuries from the
potential dust explosion that could have resulted from, or have been
exacerbated by, the location of the
enclosureless portion of the dust collector in the adjacent room, lack of
a backflash damper on the exhaust
ductwork and the lack of deflagration vents for the cyclone collector:
(a)The dust collection system and the ductwork used to collect the wood
dust was not protected
by a deflagration vents for the enclosureless portion of the ventilation
system and a back flash
damper in the event of a fire or explosion, on or about January 14, 2009.
(b)The cyclone did not have any deflagration vents to realease excessive
pressure in the event of a
wood dust explosion, on or about January 14, 2009.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO
CORRECT THESE HAZARDS INCLUDES FOLLOWING NFPA 664, STANDARD FOR
PREVENTION OF FIRES AND EXPLOSIONS IN WOOD PROCESSING AND WOODWORKING
FACILITIES, 2007 EDITION, INCLUDING BUT NOT LIMITED TO: INSTALL A BACK
FLASH
DAMPER ON THE EXHAUST DUCTWORK. PROVIDE DEFLAGRATION VENTING FOR
ENCLOSURELESS PORTION ROOM. PROVIDE DEFLAGRATION VENTS FOR CYCLONE
PORTION OF DUST COLLECTION SECTION TO RELASE PRESSURE IN THE EVENT OF A
DUST EXPLOSION.
