Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to falling/dropped loads:
(a)Plant 3 - Employees used a below-the-hook lifting device to move molds
for the block
machine.  The lifting device did not have permanently affixed, durable
identification stating the
manufacturer, manufacturer's address, serial number, and the lifting
device weight.
Additionally, the lifting device did not receive all required inspections,
on or about June 11,
2009.
ABATEMENT NOTE:  Among other methods, one feasible and acceptable
abatement method to
correct the hazard includes, as specified in the American National
Standards Institute safety standard
Below-the-Hook Lifting Devices (ASME B30.20-2003), using a nameplate or
other permanent
marking, display the following information on the below-the-hook lifting
device:  Manufacturer's name
and address, serial number, lifting device weight (if over 100 pounds or
45 kg), and rated load
capacity.  Conduct every-lift, frequent, and periodic inspections of the
below-the-hook lifting device,
and keep documentation records of the periodic inspections or make an
external code mark on the
lifting device to indicate that the periodic inspection occurred.
