Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing and/or struck-by hazards from falling racks and/or stored materials: (a) Warehouse, aisle 14 and surrounding areas, for employees loading, unloading and working nearby the storage racks where the support posts were damaged and having exposure to potential crushing and/or struck-by hazards. Among other methods, one feasible and acceptable means of abatement would be to repair or replace the damaged posts. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter").tion
