Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: struck-by hazards from the on coming traffic which was
traveling at speeds
of up to 35 mph on the two-way highway.
On or about Wednesday Augusta 12, 2009 at the 1075 2243 Dresden Drive &
Bragg Street
Atlanta, GA 30341 location were an employee was directing traffic at one
end of the roadway
and two other employees were working in area where the traffic was moving
at speeds up to 35
mph without wearing high-visibility safety apparel to warn the on coming
traffic.
There was a feasible and useful method to correct the hazard and some
methods, include, but
are not limited to:
The employer following the MUTCD manual which recommends flagger shall
wear safety
apparel meeting the requirements of ISEA "American National Standard for
High-Visibility
Apparel.
Also, follow the Worker Safety Considerations in the MUTCD manual which
recommends all
workers exposed to the risks of moving roadway traffic or construction
equipment should wear
high-visibility safety apparel meeting the requirements of ISEA "American
National Standard
for High-Visibility Apparel.
No abatement certification or documentation is required for this item.

employer did not

were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: amputation and caught-in hazards from the rotating knives
by not ensuring the
"Last Chance Stop System" was maintained and serviced so it was always
operational if needed.
On or about Wednesday Augusta 12, 2009 at the 1075 2243 Dresden Drive &
Bragg Street
Atlanta, GA 30341 location the employer failed to maintain and service the
Last Chance Stop
System by ensuring it was always operational if needed.  The Last Chance
Stop System cable
was broken from the control bar on both sides of the chipper.
There was a feasible and useful method to correct the hazard and some
methods,
include, but
are not limited to:
The employer following the daily inspections and operational checks
recommended by the
manufacturers and owners' instructions that requires the Last Chance Stop
System to be
maintained and service daily to ensure it is always operational if needed.
Performing daily
inspections and operational checks would identify deficiencies noted
during the inspection such
as but not limited to:  Locking pin for the shoot bent; Valve assembly for
over side controls
broke; Winch cable rope used to retrieve large trees is damaged and Left
fender missing.
Also, the employer following the recommendation in the (ANSI) Z133.1-2006
Section 6.3.4
which requires the brush chippers equipped with a mechanical infeed system
shall have a quick
stop and reversing device on the infeed system.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.
