Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, the use of seat belts by employees operating forklifts were not enforced, exposing employees to being caught in or crushed by a fork lift or fork lift load in the event of a forklift tip-over or other accident: (a) Location - Street side of business at 689 Salem Street, Malden, MA: On or about September 19, 2008, an employee was not properly protected from a forklift tip-over by wearing the provided seat belt.
