Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employement and a place of employment that were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees, in
that employees were
exposed to inhalation hazards associated with anhydrous ammonia.
Machinery room: On or about May 08, 2009, employees were not adequately
protected against
the potential release of anhydrous ammonia in that:
a. A door communicating with the building's syrup area opened into and not
out of the
machinery room.
b. Audible and visual ammonia alarms were not provided on the outside of
doors communicating
with the machinery room, specifically the three doors on the NE side of
the machinery room,
also the door between the machinery room and the syrup area, with reset to
be located inside
the machinery room.
c. A schematic drawing or panel giving directions for the operation of the
refrigeration system
was not provided at a location convenient for the operators of the
equipment.
d. Entrances to the refrigerating machinery room were not provided with
permanent legible and
securely attached signs reading "Machinery Room--Authorized Personnel
Only", specifically the
three doors on the NE side of the machinery room, and further
communicating that entry is
forbidden except by those personnel trained in emergency procedures when
the ammonia alarm
has been activated, specifically all of the five doors communicating with
the machinery room.
e. Emergency shutdown procedures, including precautions to be observed in
case of a breakdown
or leak, were not posted outside of the machinery room, immediately
adjacent to each door.
Among other methods, feasible and acceptable methods to control these
hazards
are to adhere
to the safe design, installation and operation of anhydrous ammonia
refrigeration systems as
prescribed by ANSI/ASHRAE 15-2007, "Safety Standard for Refrigeration
Systems",
specifically:
a. Reconfigure the door communicating with the syrup area to open out of
the machinery room.

b. Provide audible and visible ammonia alarms outside of each machinery
room door with reset
inside the machinery room. (Section 8.11.2.1)
c. Provide a schematic drawing or panel giving directions for the
operation of the refrigeration
system in a location convenient for the operators. (Section 11.7)
d. Provide legible permanent signs, securely attached and easily
accessible, reading "Machinery
Room--Authorized Personnel Only" on the three doors on the NE side of the
machinery room,
and further communicating that entry is forbidden except by personnel
traine in emergencyprocedures when the ammonia larm has been activated on
all five machinery room doors.

e. Post emergency procedures outside the machinery room immediately
adjacent to each door.
