General-duty citation text
Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about November 9, 2009, at the above addressed jobsite, employees performing demolition operations were exposed to struck-by and caught in between hazards when working in the areas of a Caterpillar 345C hydraulic excavator and Link Belt 460 LX hydraulic excavator where the swing radii were not provided with a method to prevent employees from entering. Among other methods, feasible and acceptable means to correct these hazards are to use a safe alternate method, such as: Comply with the Equipment Manufacturers Institute (EMI) Hydraulic Excavator Safety Manual which states: "Never enter of allow anyone to enter the excavator swing pivot area. Death or serious injury can result."
