Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential fire and explosion hazards: (a) In the pellet storage bin located at American Crystal Sugar in Drayton, North Dakota, an employee was using a diesel powered Caterpillar 906 compact wheel loader to move pellets to a conveyor. The Caterpillar was not approved for use in a Class II, Division 1, hazardous location where large volumes of combustible dust were present. Among other methods, one feasible and acceptable means of abatement would be for the employer to follow the guidelines established in NFPA 505 Fire Safety Standard for Powered Industrial Trucks Including Type Designations, Areas of Use, Conversions, Maintenance, and Operations, Section 4.2.6. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter").tion

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and/or explosion hazards: (a) In the boiler area at American Crystal Sugar in Drayton, North Dakota, a bucket elevator used to convey coal for the boiler system was not equipped with deflagration venting, a suppression system, pulley and/or belt alignment monitors, bearing heat sensors, vibration detection, or an alarm system for prevention or control of potential ignition sources. Among other methods, one feasible and acceptable means of abatement would be for the employer to follow the guidelines established in NFPA 654 Standard for the Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Combustible Particulate Solids, Section 3.10 - Bucket Elevators.
