Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazards of being thrown from or crushed by
in-plant railcars:
The employer does not ensure that the in-plant railroad tracks are in safe
operating condition
exposing employees to crushing hazards from derailing railcars.  This
violation was most
recently observed at the employer's worksite located at 407 West Brentwood
on or about
November 11, 2008 on track "G", and times prior thereto, where a railcar
derailed at the joint
between the 60# and 100# rails that were observed not securely joined
together.
Among other methods, feasible and acceptable means to correct the hazards
are (1) to ensure
that the proper size rails, compromise bars or other connecting devices,
are joined together and
securely bolted; (2) implement and conduct monthly or more frequent
inspections of the tracks
to monitor and assess the tracks' condition.

Pursuant to 29 C.F.R. 1910.19, within ten (10) calendar days of the date
of this citation, the
employer must submit documentation showing that it is in compliance with
the standard,
including describing the steps that it is taking to ensure that tracks are
maintained
in safe
operating condition.
