Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On or about September 24, 2008, at the west wall of Knight LLC Bldg 402, a midrail was not in place on one end of the scissor lift platform exposing employees to a 20 - 25' fall hazard. Among other methods, one feasible and acceptable means to correct this hazard include, but are not limited to, enforcing use of the chain midrail provided as part of the guardrail system of the scissor lift in accordance with ANSI/SIA A92.6 (1999), "Self-Propelled Elevating Work Platform".
