Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that are likely to cause death or serious harm to employees. Employees were exposed to the hazards of falls while riding up/down in a scissors lift at the Lombard job site. John B. Sanfilippo & Sons Inc. Instance: A Employees operating a JLG Model 3246ES Scissors lift, were not trained in the operation of the unit. Instance B: The employer did not ensure that daily inspections were performed on their JLG Model 3246ES Scissors lifts prior to use. A feasible means of abatement is to follow the American National Standards Institute ANSI/SIA A92.3-1990 Manually Propelled Elevating Aerial Platforms Section 7.3 Responsibilities of Users to Inspect and Section 8.5 Responsibilities to ensure operators were trained. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d)
