General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were riding in the bucket of a backhoe. On November 19, 2009, an employee rode in the bucket of a backhoe to secure a communication line to an electrical power drop exposing the employee to a fall hazard of 16 feet. Among other methods, feasible and acceptable abatement methods could include, but are not limited to: Following the Operation & Maintenance Manual For the excavator which states on the front cover "Unsafe Use of this machine may cause serious injury or Death. Operators and maintenance must read this manual before operating or maintaining this machine." and on Page 2-13 "Never let anyone ride on the work equipment or other attachments. There is a hazard of falling and suffering serious injury." Following the General Safety precautions of the quick coupler on the excavator, JRB Hydraulic Smartloc Coupler Manual page 5 which states. "Do not allow riders on the attachment or the prime mover." Following the Equipment Manufacturers Institute (EMI) Safety Manual for Hydraulic Excavators which states the following on page 20. "Never use a bucket for a work platform or personnel carrier." Following the NIOSH Preventing Injuries When Working with Hydraulic Excavators and Backhoe Loaders which states "Never permit workers to ride in or work from excavator or backhoe loader buckets." Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
