Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, the use of seat belts by employees operating forklifts was not enforced, exposing employees to crushing injuries in the event of a forklift tip-over accident. a) On or about June 22, 2010. The forklift operator was not wearing the seat belt that was provided with the power industrial truck as per manufacturer instructions. A feasible method to prevent this hazard from occurring again is to prevent employees from operating powered industrial trucks without wearing seat belts. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIREDATION employees in that, the use of seat belts by employees operating forklifts was not enforced, exposing employees to crushing injuries in the event of a forklift tip-over accident. a) On or about June 22, 2010.
