Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls: (a)On or about 02/18/09, at the construction site located at 2301 Menard Hwy, Brady TX, where employees were standing on the midrail of a Genie GS-2032, and JLG scissor lifts to reach higher work elevations, exposing employees to the hazard of falls. "Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with the manufacturer's requirements and ANSI/SIA A92.6-1999 for Self Propelled Elevating Work Platforms. Section 8.10(9) requires "Personnel footing. Personnel shall maintain firm footing on the platform floor while working thereon. Climbing by occupants on the midrail or toprail of the aerial platform is prohibited."
