29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. On or about February 8, 2013, the platform attached to the Square Shooter fork lift, used to lift materials and personnel, was not designed by a qualified person. The platform extended more than 10 inches beyond the wheel base creating a stability hazard.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use. On or about February 8, 2013, a platform was attached to the Square Shooter lift and used to lift materials and personnel to the roof. The platform was not approved by the manufacturer of the lift.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems. On or about February 8, 2013, employees installing a metal roof at a height above 15 feet were not provided fall protection. Bolton Steel Erectors was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.760(a)(1) which was contained in OSHA inspection number 314274598, Citation 1, Item 1 issued on 08/24/2010 and became a final order on 09/22/2010.

29 CFR 1926.761(b): Fall hazard training. The employer shall train each employee exposed to a fall hazard in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program. On or about February 8, 2013 the employer had not instituted a training program for employees exposed to fall hazards when working at heights over 15 feet.
