Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and/or being struck by automotive lifts. a)Garage, Automotive lift in position 6: Lift, marked as "Do Not Use, Out of Service" was in use, on or about 7/31/2009. Employee was working beneath automotive lift with a broken/defective hydraulic system. b)Garage, Automotive lifts in positions 1,2,4,5,6,7: Lifts were not inspected and/or maintained according to ANSI Standards for Automotive Lifts on or about 7/30/2009. Hydraulic automotive lifts used by employees were not inspected and maintained in accordance with ANSI/ALI ALOIM-2000. ABATEMENT NOTE: One feasible means of abatement to correct this hazard is to establish, implement and maintain a preventive maintenance program that includes inspection procedures as recommended by the manufacture, the American National Standards Institute (ANSI) and the Automotive Lift Institute. The employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
