Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by: At J.Curry Redi-mix of Rushville, Inc., employees are exposed to the hazard of being struck by the Allis-Chalmers Wheel Loader because the brakes on the loader do not work and the driver controls the movement of the loader by the forward and reverse drive and the parking brake. Among other methods, one feasible and acceptable abatement method to correct this hazard is to take the Allis-Chalmers Wheel Loader out of service and use the second wheel loader at the site. ***Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c)***
