26 CFR 1910.95(c)(1):  The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average (TWA) of 85 dBA, or equivalently a dose of 50%:    The employer did not establish and maintain a continuing, effective hearing conservation program when employee exposure to noise exceeded an eight-hour time-weighted average of 85 decibels:    On September 7, 2011 a driver was exposed to an eight hour time-weighted average (TWA) of approximately 97.5 dBA during the 30 minute sampling period while chipping concrete from a mixer truck; zero exposure was assumed for the unsampled period of 450 minutes.     An effective Hearing Conservation Program shall include at least:    1.	Periodic monitoring and monitoring for changes in the process;     2.	Baseline and annual audiometric testing;     3.	Hearing protectors in a variety of types that is required to be worn; and    4.	Annual training for the hazard of noise and use of hearing protection devices:    a.	The effects of noise on hearing;  b.	The purpose of hearing protectors, the advantages, disadvantages, and attenuation of various types, and instruction on selection, fitting, use, and care; and  c.	The purpose of audiometric testing and an explanation of the test procedures.
