Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Employees attaching tarps to the warehouse ceiling to capture water from leaks were exposed to falling approximately 9 feet from a platform attached to a Hyster Lift Truck and the work platform did not have a guardrail. Among other feasible and acceptable methods to correct this hazard is to provide a platform that meets the requirements of ASME B56.1-2004, paragraph 7.37.1 (d) Platforms used for elevating personnel shall have restraining means such as a guard rail whenever the platform can be elevated to a height greater than 1200mm (48in). ***Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c)***
