Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer did not ensure that employees were protected from unsafe conditions as follows: a.At 4886 Frank Sinatra Drive, Las Vegas NV, at the southeast corner of the Sobella Retail Project, three employees utilized a Snorkel TB85J aerial lift #80754 as a hoisting device to lift and place an aluminum mullion. The employees were exposed to possible serious injuries from the potential instability of the aerial lift being used to hoist materials. Reference: Snorkel TB85J Operator's Manual, Chapter 3 - Safety Page #13 - "Do not use the aerial platform as a crane, hoist, jack, or for any purpose other than to position personnel, tools, and materials." One feasible means of abatement would be to follow the manufacturer's instructions.s
