Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer
does not furnish employment and a place of employment which is free from
recognized hazards that cause or are likely to cause death or serious
physical harm
to employees in that employees are exposed to:
the hazards of falls while performing maintenance activities and repairs
while working on an UpRight mobile scaffold, at the Gulf Greyhound Race
Track in La Marque, TX, on or about the date of November 19, 2010,
when an employee ascended on to the third tier of the scaffold which tipped
and fell.
Among other methods, recognized and feasible means of abatement to correct
the
hazard is to comply with the:
Manufacturer's UpRight Instruction Manual, Span Scaffolds:
1)Scaffolds shall be erected, moved and dismantled only by, or under
the supervision and direction of, a competent person.
2)Always make sure all locking hooks are firmly in position an latches
are properly engaged. Never force locking hooks.
3)Always use four OUTRIGGERS if platform height will exceed three (3)
times any minimum base dimension (see Figure 4, page 3).
American National Standards Institute (ANSI)/American Society of Safety
Engineers
(ASSE) Standard A10.8-2001, General Requirements for all scaffolds:
1)Paragraph 4.1, Scaffolds shall be furnished, erected, and used in
accordance with this standard na available manufacturer
specifications for persons engaged in work that cannot be done safely
from the ground or from a permanent structure.
2)Paragraph 4.43, All employees using scaffolds to perform a job task
shall be instructed by a qualified person in the proper construction,
use, placement, care, and recognition of hazards for the scaffolds they
are using.
3)Section 11, Manually Propelled and Prefabricated Mobile Scaffolds,
Paragraph 11.3.3.4, Scaffolds shall be erected, used, and
disassembled in accordance with the instructions furnished by the
manufacturer.
