Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to serious struck-by hazards. Employees, using a JLG G-55A Rough-Terrain Forklift hoist structural steel members by its forks, were exposed to serious struck-by hazards. This action is against the manufacturer's recommendations (pg. 1-7, Never suspend load from forks or other parts of the carriage). Among other methods, one feasible and acceptable means of abatement would be to use a crane to lift structural steel members into place. There is no abatement certification or documentation required for this item.
