Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees.
Employee(s) were
exposed to the hazard of rollover and/or struck by while operating an All
Terrain Vehicle
(ATV):
a) Tangent Rail Products, Alexandria, LA.; On or before 06/17/10, the
employer failed to
ensure that employee(s) operating a 2003 Yamaha Kodiak All Terrain Vehicle
(ATV) on rough,
sloped, uneven terrain had been trained, were qualified, and safely
operated ATVs including,
but not limited to, appropriate speeds, operating surfaces, emergency
braking and maneuvers,
tire pressures, and driving behavior. Feasible and acceptable abatement
methods to correct this
hazard include: 1) Obtaining the operator's manual for the model of ATV
used and ensuring
employees are familiar with the safe operating instructions; and 2)
Implementing an ATV safety
training program such as the ATV Safety Institute's "RiderCourse" to
provide hands-on training
and knowledge of proper ATV operation.
