Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to the hazard of being struck by
moving traffic on
a highway:
a)At the jobsite, employees were working to prepare their next day's work
and they were
crossing back and forth over US HWY 17-92 which had heavy moving traffic
of trucks
and cars which exposed the employees to the hazard of being struck by the
traffic
because the employees were not wearing high visibility garments.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to have the employees wear high visibility garments so that
drivers on the busy
highway can see the crossing employees and take the appropriate actions to
avoid
employee injury.
