OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm or death to employees, in that employees were exposed to struck-by hazards from vehicular traffic/construction equipment: a. At the Tapestry, Phase 1 subdivision, employees were exposed to struck-by hazards while working in close proximity to vehicular traffic/construction equipment inside a construction work zone. On November 19, 2015, an employee installing a silt fence at the southwest corner of a pond in the area of Chantilly Avenue and Chateau Loop was struck by a truck carrying soil cement.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a. At the Tapestry, Phase 1 subdivision, employees were exposed to construction workplace hazards, including a struck by hazard while working near an operating bulldozer and the travel path of trucks delivering material, and they had not been trained to recognize those hazards.
