Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed tothe hazards of
explosion and fire:
a) On or about 07-29-09, the aluminum dust collection system for the
Wheelabrator polishing
machine was not grounded and bonded, thereby exposing the employees to a
fire/explosion
hazard.
b) On or about 07-29-09, the aluminum dust collection system for the
Wheelabrator polishing
machine used an exhaust duct constructed of PVC, thereby exposing the
employees to a
fire/explosion hazard.
c) On or about 07-29-09, the dust collection hoods and ductwork were not
cleaned regularly to
remove aluminum dust, thereby exposing the employees to a fire/explosion
hazard.
d) On or about 07-29-09, the aluminum dust collector was not emptied at
least daily, thereby
exposing employees to a fire explosion hazard.
e) On or about 07-29-09, the aluminum dust was not kept in closed
containers.
f) on or about 07-29-09, the employer failed to provide hoods or capture
devices in the Polishing
department to capture fugitive aluminum dust emissions, thereby exposing
employees to a
fire/explosion hazard.
Abatement methods, one feasible and acceptable method to correct these
deficiencies
is to
comply with National Fire Association (NFPA) 484 standards for Combustible
Metals as it
applies to  to your operations and equipment but not limited to:
Electrically ground and bond
all parts of the ventilation system as required in paragraph
6.3.8.2.1.*Install electrostatic type
dust collectors for the polishing belt sanders as required in paragraph
6.3.5.1 *Install a
measuring device to or implement formal testing to ensure duct velocity is
maintained at 4,500
feet per minute or greater as required by paragraph 6.3.3.*Implement a
cleaning program for
the insides of hoods and ductwork which is frequent enough to maintain the
aluminum dust
amounts to safe levels as required by paragraph 6.3.5.8. * Store aluminum
powder in sealed
containers as required by paragraph 6.1.11.1. *Provide a shovel or dust
pan made of conductive
spark resistant material as required by paragraph 6.5.7.7.3 *Provide
employees work uniforms
made of flame retardant, non-static generating material which are designed
to be easily
removable as required by paragraph 6.6.2.1.*Provide a capture device to
collect aluminum dust
coming from dust producing machinery as required by paragraph 6.3.2.1.
