Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to
caught-between hazards:
On or about 12/03/2009, at NW 55th Ct. and 3rd Street, in Miami, Florida,
an employee, an
operator, did not maintain adequate clearance between a Palfinger
rolling-base crane and
headboard.
ABATEMENT NOTE: Among other methods, one feasible and useful method to
correct the
hazard is for the employer to ensure the avoidance of operating situations
where there is risk to
personnel of crushing and to ensure that adequate clearances are
maintained between the operator
and the base-mounted-crane as indicated in figure SS-1 of the crane
manufacturer operator's
manual.
