Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm. Employees were exposed to the hazards
associated with dust explosion,
deflagration, or other fire hazards:
a.On or about January 27, 2010, at the establishment, the employer had
used non-metallic ductwork to
connect woodworking machines to the Dustek enclosureless dust collection
system. The non-metallic
ductwork was used to connect the following machines:
SCMI Shaper, serial #KF510784
Delta Table Saw, serial #1184015
Rockwell Planer, serial #82
SCMI Sander, serial #SA00212
Delta/Rockwell Radial Arm Saw, serial #CS9682
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method to
correct this hazard includes following NFPA 664, "Standard for the
Prevention
of Fire and Explosions
in Wood Processing and Woodworking Facilities", (2007 Edition), including,
but not limited to,
ensuring all dust collection system components are metallic to minimize
the build up of static
electricity.
b.On or about November 20, 2009, at the establishment, the Dustek
enclosureless dust collection system
was not located at least 20 feet from any means of egress or area
routinely occupied by personnel.
ABATEMENT NOTE: Among other methods, one feasible and acceptable method to
correct this
hazard includes following NFPA 664, "Standard for the Prevention of Fire
and Explosions in Wood
Processing and Woodworking Facilities", (2007 Edition), including, but not
limited to, relocating the
dust collector or the woodworking machines and egress routes to meet the
20 foot off-set requirement.
