Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazards of being struck by Kubota Wheel Loaders, while working in the two areas where the Wheel Loaders operate. Employees work and walk in the North end tipping floor areas, and in the South end of the facility that includes the material bunkers. A feasible and acceptable means of abatement includes, but is not limited to the following actions: 1. Provide a spotter to direct the Wheel Loader operators and employees during all instances employees walk and work near the Wheel Loaders. 2. Provide reflective or high-visibility clothing 3. Train employees to recognize the importance of wearing high-visibility clothing and enforce company safety rules that require employees to wear such clothing, 4. Use and maintain the Kubota Wheel Loaders as required by the manufacturer, with operating backup alarms.
