Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
The hazards of being struck by vehicles including Komatsu Wheel Loaders
and Bobcats operated
in two areas inside of the facility.  Loader operators drive their
vehicles in the North end tipping
floor area, and in the South end that includes the material bunkers.
These loader operators get
out of their vehicles to check or adjust loads, and are exposed to being
struck by another vehicle
operator.
A feasible and acceptable means of abatement includes, but is not limited
to, the following
actions:  1. Provide a spotter or signalman to prevent other vehicles from
striking
them.  2.
Provide reflective or high visibility clothing to the vehicle operators.
3. Train the operator
employees to recoginize the importance of wearing high visibility clothing
and enforce company
safety rules that require employees to wear such clothing. 4. Use and
maintain the Komatsu as
required by the manufacturer, with operating backup alarms.
