Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to asphyxiation hazards while working in float gunnels: a) On or about April 10, 2009 employees entered the gunnel of the float on the east dock to repair leaks prior to determining acceptable entry conditions into this confined space. Employees did not adhere to established confined space procedures including not conducting atmospheric testing with properly calibrated and working equipment and not having means of rescue in place during entry. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to follow the existing written Cincinnati Bulk Terminals, L.L.C. Confined Space Program.
