29 CFR 1915.111(a): All gear and equipment provided by the employer for rigging and materials handling shall be inspected before each shift and when necessary, at intervals during its use to ensure that it is safe. Defective gear shall be removed and repaired or replaced before further use. a) On or before September 18, 2023, the employer did not ensure that adequate inspections were done on the Strongway 12-Ton Bottle Jack and other rigging equipment to ensure it was safe prior to use.

29 CFR 1915.116(k): Pieces of equipment or structure susceptible to falling or dislodgement shall be secured or removed as early as possible. a) On or about September 18, 2023, the employer did not ensure that pieces of equipment such as the Strongway 12-Ton Bottle Jack was secured to prevent it from becoming dislodged. As a result, an employee was hospitalized due to the Strongway 12-Ton Bottle Jack becoming dislodged.
