Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being caught between the forklift and another surface or being struck by the forklift in the event of a tip over: a)Triple Star Recycling, Inc. Yard - An employee operating TMC forklift was not wearing seatbelt. AMOUNT OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO WEAR THE PROVIDED SEATBELT AS REFERENCED IN ITSDF B56.1-2005 "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS" OR FOLLOW THE OPERATOR MANUAL UNDER USE OF SEATBELT.
