Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees exposed to crushing injuries in the event of an accident and/or equipment roll over when the provided seat belt was not utilized: a.Suncrest Town Centre: The provided seat belt on the 2003 Bobcat 331 series skid loader, was not being worn by the operator, as determined on or about 08/24/09. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard includes, but not limited to, enforce employee usage of seat belts when operating earth moving equipment and follow the Bobcat owner's manual.
