Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recogn ized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a fall of 10 feet while working from an unsafe platform: (a)Plating Specialties LLC at 574A 25 Road in Grand Ju nction, CO: On June 8, 2010, one employee was lifted onto the roof of the facili ty on a pallet attached to a forklift. The employer did not ensure that the fork lift had adequate safeguards in place to protect the employee from falling. This condition exposed the employee to a fall hazard. Abatement Note: Among other me thods, one feasible and acceptable abatement method to correct this hazard is to follow all requirements as set forth in ANSI/ITSDF B56.1-2005, Safety Standard for Low Lift and High Lift Trucks, paragraphs 7.37. Abatement Note: Abatement ce rtification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter"). OR IN THE ALTERNATIVE 29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operat ion of powered industrial truck were performed by the employer without the manuf acturer's prior written approval: (a)Plating Specialties LLC at 574A 25 Road in Grand Junction, CO: On June 8, 2010, the employer used the forklift as a manlift without the manufacturers approval to use it in that capacity. An employee was lifted onto the roof of the facility on a pallet attached to the forklift. The e mployer did not ensure that the forklift had adequate safeguards in place to pro tect the employee from falling. This condition exposed the employee to a fall ha zard.
