Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards
that were
causing or likely to cause death or serious physical harm to employees in
that workers were
exposed to hazards associated with dust explosion, deflagration, or other
fire hazards within a
permit required confined space:
(a)At the Elm Road Generating Station Unit 1 site, on November 24, 2009,
AZCO
Inc. allowed two employees to enter Pulverizer E, a permit required
confined
space, using the entry permit system required by the general contractor
and:
(1)Allowed employees to work in the space despite changing work conditions
that introduced combustible coal dust into the space;
(2)In the event of a fire or explosion, did not have a means of accounting
for
which of their employees were working in the space.
Among other feasible methods, one feasible and acceptable means of
abatement would
be to comply with ANSI/ASSE Z117.1-2009 Safety Requirements for Confined
Spaces,
and (1) Immediately remove employees from a permit required confined space
whenever
hazards are encountered or created during the course of an entry permit
(in accordance
with section 5.5 of ANSI/ASSE Z117.1); (2) Inform the general contractor
immediately
whenever hazards are encountered or created during the course of an entry
permit (in
accordance with section 11.5 of ANSI/ASSE Z117.1); and (3) Coordinate with
the
general contractor so all entrants into permit required confined spaces
are accounted for
(in accordance with section 5.1.1 of ANSI/ASSE Z117.1).
Certification, with date and method of abatement required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
