Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)On or about April 29, 2010; an employee entered a sanitary sewer manhole without performing any monitoring to ensure the atmosphere was safe. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate method such as: Follow the Permit Required Confined Space Entry as outlined in American National Standard ANSI/ASME Z117.1-2003 Safety Requirements for Confined Spaces, Section 5.1 Entry Permits. A permit shall be established for all PRCS entries. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)Periodic assessment of the effectiveness of employee training was not conducted to ensure employees had the knowledge necessary to enter a confined space or permit required confined space exposing employees to potential atmospheric hazards. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate method such as: Ensure the employees obtain the knowledge necessary by evaluating the employee as outlined in ANSI/ASME Z117.1-2003, Section 15.5.1. Written, as well as practical testing is recommended. Personnel should be questioned or asked to demonstrate their practical knowledge of confined space hazards that are in their work areas, to identify locations of confined spaces, their role is exercising proper permit procedures, use and donning of personal protective equipment, such as respirators, and their role in response to emergency situations. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
