Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)In the Back Bay #2, the employer did not ensure the automotive lifts automatic mechanical locking device was functioning properly on the Rotary Lift 12,000 lb Capacity (Model SM 120-15) vehicle lift exposing employees to crushing hazards. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate method such as: Automotive Lift Institute ALI-90: Inspect your lift daily. Never operate if it malfunctions or if it has broken or damaged parts. Repairs should be made with original equipment parts. Automotive Lift Institute ALOIM-1994, Section 4.4.4 The lift owner or employer shall take all appropriate steps to follow the recommended inspection procedures of the lift manufacturer, but in no event shall the lift operator fail to inspect or take notice of the following features on a daily basis: (1)accessibility of the operating procedures, safety tips and generic safety material; (2)accessibility and readability of safety warning labels; (3)the rated load capacity of the lift; (4)proper operation of the lift controls, restrains and locking devices; (5)deformation or excessive wear of any of the lift structural components; (6)deformation or excessive wear of other components such as hoses, electrical wires, drive chains, cables or screws; (7)damage or excessive wear on any of the lift contact points which engage the vehicle during lifting, whether they engage the tires, frame, body or axles; (8)evidence of hydraulic or pneumatic leaks; (9)unusual noises, sudden movements, erratic operation or evidence of chips or filing during use; (10)cracks or loose concrete around floor anchor bolts, if employed. Automotive Lift Institute ALOIM-1994, Section 6.1.1 Preventive Maintenance Procedure. The owner or employer shall establish a periodic preventive maintenance procedure in accordance with the recommendations of the lift manufacturer in order to ensure the continued safe operation of the lift. Ensure defective lifts are removed from service. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
