Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: For the employee working in the derrick of the service rig, laying back tubing being pulled from the well on or about December 4, 2009. The employer did not ensure the employee was provided with a secondary mean of escape from the tubing board. Among other methods, one feasible and acceptable abatement method to correct the condition would be to identify and/or install a proper anchor points at the well site before or during rig up.
