Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazards of entering potentially dangerous
confined spaces:
a)On or about January 8, 2010, and at times prior, Tagawa Greenhouse
Industries did
not ensure that employees were protected from confined space entry
hazards.  Employees
entered the pad water well in Range 3 in order to service the sump pump.
Among others, a feasible and acceptable method of abatement to correct
this hazard is to
develop a confined space entry program as described in ANSI Z117.1 which
addresses the
following:
a)Identification and evaluation of confined spaces
b)Atmospheric testing of confines spaces
c)Roles and responsibilities including that of the attendant and entrant
d)Isolation and Lockout/Tagout of equipment within the space
e)Ventilation of the space
f)Personal protective equipment
g)Safeguards including retrieval equipment
h)Emergency Response
i)Training
j)Written permit system.

employees were exposed to electrical hazards due to improper installation
and use of
electrical equipment:
a)On or about January 8, 2010, and at times prior, Tagawa Greenhouse
Enterprises did
not ensure that employees were protected from electrical hazards.  Some
instances include,
but are not limited to:
1)Missing covers and knock-outs throughout the ranges.
2)Inadequate strain relief on electrical cords throughout the ranges and
in the
maintenance shop area.
3)A non-GFCI plug on a boom for the watering system in Range 3.
4)Electrical equipment enclosures, boxes and fittings located in wet areas
not
weatherproof throughout the ranges.
Among others, a feasible and acceptable method of abatement to correct
this hazard is to
establish a program that trains workers on the recognition of electrical
hazards, doing regular
inspections of electrical equipment, and performing appropriate
maintenance and repairs.

employees were exposed to crushing and tipping hazards due to improper
maintenance
and
inspection of forklifts:
a)On or about January 8, 2010, and at times prior, the Nissan forklift was
not
appropriately inspected or maintained, in that, the carriage near the
forks was severely
damaged.
Among others, a feasible and acceptable method of abatement to correct
this hazard is to
reguarly service and maintain the forklift and ensure that any damage is
repaired.
