Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to cuts/lacerations or amputations of hand and/or fingers
while cutting lumber with
a circular saw:
Worksite: Employees were not provided with appropriate safe and positive
means of "securing"
devices and/or equipment, and an employee was manually holding the pieces
of 2 X 10 lumber
that were placed on two (2) "horse" type work table while another employee
was trying to cut
lumber with a hand-held circular saw.
On or about October 23, 2009, the employee's left hand index finger came
in contact with the
saw blade and resulted in a amputation.
Among other methods, one feasible and acceptable method of abatement is to:
1. Provide employees with appropriate tools and devices.
2. Comply with the manufacturer's operator's manual.
3. Use other effective means of engineering feasibility.
4. Provide employees with training and information.
