Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associate with entering a confined space: a. On or about 9/23/09 - Patton Chapel Road & Crayrick Drive, Hoover, AL, employee(s) entered a manhole without forced air ventilation and did not perform air monitoring to test the space for contaminants. Among other methods, one feasible and acceptable method to correct this hazard is to enforce the use of a confined space program as specified in ANSI Z117.1-1995, American National Safety Institute Requirements for Confined Spaces.d
