Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that employees
were exposed to crushing injuries related to lifting operations:
a)  Mader Machine Co., Inc. - Lagrange, Ohio: On or about March 5, 2010,
the employer did
not ensure that operators of the O.S. Walker magnet (s/n 741)
below-the-hook lifting device
were instructed in the safe use of the device.  Operators were not
informed of safe practices and
operating procedures suggested by the manufacturer of the lifting device
such as, but not limited
to, how load characteristics will affect the lifting capacity, inspection
of the device, and
condition of the load thickness required for operations.
b)  Mader Machine Co., Inc. - Lagrange, Ohio: On or about March 5, 2010,
the employer did
not ensure that the O.S. Walker magnet (s/n 741) below-the-hook lifting
device handled loads
for which it was designed.  Employees were exposed to crush-by injuries in
that the .75" thick
ASTM-A588 steel plate being lifted by the magnet exceeded the magnet's
maximum size
capacity for this material.
c)  Mader Machine Co., Inc. - Lagrange, Ohio: On or about March 5, 2010,
the employer did
not ensure that employees using the O.S. Walker magnet (s/n 741)
below-the-hook lifting device
to lift steel plates stayed clear of the load.  Employees were exposed to
crush-by injuries in that
the load was not guided in a manner to avoid endangering hands or other
body parts as it is
lowered, or if it drops.
Abatement Note:  Among other methods, one feasible and acceptable
abatement method to
correct this hazard is to comply with American Society of Mechanical
Engineers (ASME)
B30.20-2006 "Below-the-Hook Lifting Devices - Safety Standard for
Cableways,
Cranes,
Derricks, Hoists, Hooks, Jacks, and Slings."
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
( using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence, or
written records.
