Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees exposed to struck-by
hazards while operating a powered industrial vehicle without using the
operator restraint device
in the event of a tip over of the vehicle while moving pallets of products:
a)Advanced Composites, Inc., 970 N. Vandermark Road, Sidney, Ohio: On or
about
March 31, 2010, the employer did not ensure that employees operating lift
trucks were
using the operator restraint device while transporting pallets of
cardboard containerized
pellets weighing approximately 1,500 pounds. The employees were exposed to
struck-by
hazards while picking orders in rows of three pallets stacked high and
four pallets deep
in the warehouse.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method to correct this hazard is to follow American National Standard,
ASME B56.1
2005, Safety Standard for Low Lift and High Lift Trucks, Section 5.3.19,
an active
operator protection device or system, when provided, shall be used.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
