Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that the use of
an aerial platform within the area of travel of a bridge crane exposed
employees to crushing
hazards:
a) Deke Enterprises, Inc. on or about November 11, 2010, at the address of
7800 State Rte. 108
in Delta, OH:  Employees were exposed to crushing hazards in that the
employer failed to assure
the Condor aerial platform was operated in a manner which would prevent a
collision with the
#2 Zenar overhead crane (s/n 6862).  Employees working from an aerial
platform in the travel
path of the overhead crane were struck by the crane.
b) Deke Enterprises, Inc. on or about November 11, 2010, at the address of
7800 State Rte. 108
in Delta, OH:  The employer did not assure that operators of the Condor
aerial platform were
instructed and familiar with safe operating procedures so as to prevent
collisions with an
overhead crane when working within the area of travel of a crane.
Among other methods, one feasible and acceptable means of abatement is to
comply with the
requirements of ANSI A92.5-2006 "Boom-Supported Elevating Work Platforms."
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
( using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence, or
written records.
