29 CFR 1910.272(l)(2)(iii):  Filter collectors installed by the employer
for the grain facility after
March 30, 1988, were not located in an area inside the facility that was
separated from other
areas of the facility by construction having at least a one hour
fireresistance rating, and which
was adjacent to an exterior wall and vented to the outside:
a) Hansen Mueller Co. - Toledo, Ohio: On or about May 23, 2011, the
employer
failed to ensure that the Jacobson (Model No. 24326 x LT) hammer mill dust
collector was located outside, in an area protected by an explosion
suppression
system, or in an area separated from other parts of the facility by a one
hour fire-
resistance rating with venting to the outside. Employees were exposed to
hazards
from fire and explosion.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
( using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence, or
written records.
