Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that, employees
were exposed to the hazards of being struck by strut springs being
released while under pressure
in the Branick Strut Spring Compressor:
Employees were exposed to struck by hazards from the Branick Spring
Compressor due to worn
or missing hooks and rubber hook pads that contain the compressed spring.
Four hooks were
visibly worn, one rubber hook pad was missing and the remaining five
rubber hook pads were
visibly worn.
A feasible and useful method to correct this hazard, among other methods:
1. Institute a
preventive maintenance program according to the manufacturer's
specifications.
2. Provide
training to employees on the hazards of operating the Strut Spring
compressor and the methods
to control or eliminate those hazards including but not limited to
following instructions in the
compressor operator's manual.  3. Schedule and complete periodic annual
inspections.
PEP BOYS #0190 WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS
OCCUPATIONAL SAFETY AND HEALTH STANDARD WHICH WAS CONTAINED IN
OSHA INSPECTION NUMBER 310677513, CITATION NUMBER 1, ITEM 1, ISSUED ON
MARCH 21, 2008, WITH A FINAL ORDER DATE OF OCTOBER 30, 2008, AND A FINAL
ABATEMENT DATE OF MAY 7, 2008.
