Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees:
a.  On or about April 13, 2010, at the above addressed jobsite, an
employee was performing tree
planting operations from the forks of a Bobcat A300 Skid Steer Loader, the
employee was
thereby exposed to injuries from falls created by the improper use of the
Skid Steer Loader.
One feasible and acceptable abatement method includes, but is not limited
to the following: a.
Follow the Manufactures Operation & Maintenance Manual for users and
operators of skid steer
loaders which states, "Never use loader as a man lift or elevating device
for personnel." The
violative action taken by these employees is contrary to the Davey's
safety procedures, training
and monitoring and disciplinary policy.inary
